These Terms and Conditions govern the basis on which we agree to provide childcare services to you

Crazy 4 Kids’ Obligations and Your Obligations


1. Obligations on Crazy 4 Kids

1.1.     We will:

1.2.     Inform you as soon as possible as to whether your application for a place for your child at Crazy 4 Kids has been successful.

1.3.     Provide the agreed childcare services on the agreed days / sessions (subject to any setting closure dates).

1.4.     Be as flexible and as accommodating as we can with regard to any requests re changes in sessions, additional sessions or extended hours.

1.5.     Provide you (or your representative) with verbal feedback on how your child has been whenever they have been in our care.

1.6.     Notify you as soon as possible of any unexpected days we may be closed, i.e. snow days.

1.7.     Try to make available any sessions that you require for any siblings to any of your children already attending Crazy 4 Kids although we may not be able to guarantee this.


2. Obligations on You

2.1.      Before your child starts with Crazy 4 Kids you will complete in full an Admission’s Form and return to your setting along with your First Full Month’s Payment.

2.2.      Complete a Crazy 4 Kids Medical Questionnaire if your child has any specific medical needs that we need to be aware of and inform us immediately of any changes.

2.4      Complete a Medicine Consent Form if you require our staff to administer any medication to your child either prescribed or ‘over the counter’ whilst they are in our care.

2.5      Immediately inform us if your child is suffering from any contagious disease. For the benefit of other children in the ‘setting’ you must not allow your child to attend if they are suffering from a contagious disease and we reserve the right to ask you to collect your child immediately if we believe they have a contagious disease.

2.6      Immediately inform us of any changes to your contact details and change of address.

2.7      Keep us informed of the identity of the persons who will be collecting your child. If the person collecting your child is not usually responsible for collecting them we will require proof of identity and a password to be given. If we are not reasonably satisfied that an individual is allowed to collect your child, we will not release your child into their care.

2.8      We will not release any child into the care of someone under the age of 16 years; we reserve the right to request proof of age and to not release the child if we feel the person collecting is not responsible.

2.9      Inform us if your child is subject to a Court Order and provide us with a copy of such order on request.

2.10     Inform us immediately if you are unable to collect your child by the official collection time (late collection fees apply).

2.11     Inform us at least 24 hours before that your child will not be attending.

2.12    Give at least one month’s notice in writing to any changes to your child’s regular attendance, i.e. changes in days, reductions in hours, increase of hours / days or to withdraw your child completely. Any reduction in hours or days attending given with less than one month’s notice will still be liable for payment until the one month has expired.


3. Payment & Fees

3.1       Fees are charged either on a daily, sessional or hourly basis and charged monthly in advance with monthly invoices being generated the last Friday of the preceding month. All fees must be paid by the 7th of each month.

3.2       Failure to pay your invoice before the due date may result in a £25 Administration Charge being added and may result in your child’s place being suspended.

3.3       Crazy 4 Kids’ reserves the right to pass on to our Debt Management Company any fees outstanding after 60 days and you will be liable for any additional fees incurred.

3.5       You will be notified in writing one month in advance of any changes to your fees or how we calculate your fees.

3.6       All payments made by you to Crazy 4 Kids Ltd must be made in the following way; by BACS payment, College or University Bursary, Childcare Vouchers or Standing Order. Under exceptional circumstances we may agree to payment by cash but it is your responsibility to obtain a receipt from your setting Manager / Supervisor.

3.7       Any additional sessions booked after the invoice has been generated for that month will be added to your next invoice.

3.7a     Holiday Club bookings received in the same month will be invoiced upon booking.

3.7b     Sessions booked on a ‘one off’ basis must be paid at the time of booking or on the day of attendance.

3.8       No refund will be given for any period of absence by your child due to illness, family holidays, school trips or outings.


4.  Suspension of Your Child’s Place – we may suspend your child’s place due to any of the following:

4.1     You have failed to pay your fees on time

4.2     Your child’s behaviour whilst in attendance at Crazy 4 Kids Ltd is deemed by us as unacceptable or endangers the safety and / or well-being of the other children or staff. Suspension may be the correct course of action whilst we are working with you to resolve a particular issue.

4.3    If the period of suspension exceeds one month, either of us may terminate the contract by giving written notice with immediate effect.

4.4     Your behaviour toward a Crazy 4 Kids’ staff member is deemed to be abusive or aggressive in manner or if the member of staff feels intimidated.


5. Termination of your Contract with Crazy 4 Kids Ltd

5.1     You may end your contract with Crazy 4 Kids Ltd by giving us one calendar months’ notice in writing.

5.2     We may immediately end this contract if:

5.2a   You fail to pay your fees and have become uncontactable and are not responding to any of our efforts to communicate with you.

5.2b   You behave inappropriately as we will not tolerate any physical or verbal abuse towards our staff or other users of Crazy 4 Kids Ltd.

5.2c   Your child’s behaviour is unacceptable or endangers the safety or well-being of any of the children or staff at Crazy 4 Kids Ltd.

5.2d   We take the decision to close the setting down due to low occupancy or loss of premises; we will give as much notice as possible of such a decision.

5.3     You may immediately end this contract if:

5.4     We have breached any of our obligations under this agreement and we cannot put right that breach within a reasonable period after you have drawn it to our attention.

5.5     We suffer any insolvency.


6. Employment of Crazy 4 Kids Ltd Staff

6.1     If, during your Contract with us and for a period of 6 months after it has terminated, directly or indirectly employ or otherwise engage the services of any member of the Crazy 4 Kids’ Staff that has had contact with your child and allow or permit any childcare services to your child, you shall be liable to pay Crazy 4 Kids Ltd 20% of the gross annual salary of that member of staff at the time of their leaving. This figure represents the costs to us of recruiting a suitable replacement member of staff.


7. General

7.1     We have an obligation to report any instances where we consider that a child may be at Risk of Harm through neglect or abuse to the relevant authorities. We may do so with or without your consent and with/without informing you.

7.2     If the setting that your child attends has to close or we make the decision to close due to events or circumstances out of our control we shall be under no obligation to provide alternative childcare facilities for you or refund any fees. If the closure exceeds 3 days in duration (excluding any days that your setting would normally be closed), we will credit you with an amount that represents the number of days your setting is closed in excess of the 3 days.

7.3     If you should have any concern over the services that we provide please discuss this in the first instance with your Setting Supervisor / Manager; if it cannot be resolved this way then the Registered Provider will be notified of your concern and will respond to your concerns within 24 hours of receiving it.

7.4     We ensure that all of our settings have a wide variety of equipment so request that your child does not bring in toys from home; if they do bring them in, we take NO responsibility for their loss or damage.

7.5     In the interest of keeping all children ‘Safe’ we request that children do not bring any devices into a Crazy 4 Kids setting that can access the internet without WIFI or can take photographic images of the other children whilst they are in attendance.

7.6     Parents and / or their representatives whilst dropping off or collecting children MUST NOT use their mobile phone whilst on a Crazy 4 Kids’ premises and may be asked to leave or refused entry if they are found to be doing so. This is to safeguard all children in attendance and we appreciate your co-operation in maintaining the safety of all attending.


Information Sharing

Why do we collect personal data about you?

We collect personal data from you so we can provide education and children’s services to you and your family; to monitor our work; and to let us fulfil our statutory obligations and statutory returns as set by the law.

How we protect and use your personal data

All personal data we collect from you complies with the data protection principles, as stated in the Data Protection Act 1998 (DPA) and Registration with the Information Commissioner’s Office. The personal data we collect may be held as an electronic record our data systems and as a paper record. The records are only seen by staff who need the personal data so they can do their job. The security of the data follows NCC policies on Information Management. We make every effort to keep your personal data accurate. If you tell us of any changes in your circumstances, we can update the records with the personal data you choose to share with us. We will keep the personal data for no longer than is necessary. Sometimes, the law sets the length of time personal data must be kept.

Sharing personal data

So we can provide the right services at the right level, we may share your personal data within county council services or with relevant organisations in line with NCC data registration, please see link above. Where this is necessary we will comply with all aspects of the Data Protection Act 1998.

Your rights

You have the right to ask us to stop processing your personal data in relation to any council service. However, this may stop us delivering a service to you. Where possible, we will do as you ask, but we may need to hold or process personal data to comply with a legal requirement. If you find that the personal data that we hold is no longer accurate, you have the right to have this corrected.
