Crazy 4 Kids Ltd Parental Contract 2019/20
These Terms and Conditions govern the basis on which we agree to provide childcare services to you; they state Crazy 4 Kids’ Obligations and Your Obligations.
1. Obligations on Crazy 4 Kids
1.1. We will:
1.2. Inform you as soon as possible as to whether your application for a place for your child at Crazy 4 Kids has been successful.
1.3. Provide the agreed childcare services on the agreed days / sessions (subject to any setting closure dates or circumstances out of our control).
1.4. Be as flexible and as accommodating as we can with regard to any requests for changes in sessions, additional sessions or extended hours.
1.5. Provide you (or your representative) with daily verbal feedback on how your child has been whenever they have been in our care.
1.6. Notify you as soon as possible of any unexpected days we may be closed, i.e. snow days.
1.7. Try to make available any sessions that you require for any siblings to any of your children already attending Crazy 4 Kids although this will be strictly subject to availability.
1.8 If we are unable to fulfil a request for a place, you will be offered a place on the waiting list. Places on the waiting list will be allocated firstly to those requiring a full-time place and subsequently to those requiring part time places.
1.9 We will notify you in writing one month in advance of any changes to your fees or how we calculate your fees.
2. Obligations on You
2.1. Before your child starts with Crazy 4 Kids you will complete in full an Admission’s Form *along with any other medical / medication forms where applicable.
2.2. Inform us immediately of any changes to your circumstances or requirements.
2.3 Complete a Medical Consent Form if you require our staff to administer any medication to your child either prescribed or ‘over the counter’ whilst they are in our care.
2.4 Immediately inform us if your child is suffering from any contagious disease.**
2.5 Immediately inform us of any changes to your contact details and change of address.
2.6 Keep us informed of the identity of the persons who will be collecting your child. If the person collecting your child is not usually responsible for collecting them, we will require proof of identity and a password to be given before we will release your child***
2.7 We will not release any child into the care of someone under the age of 16 years.
2.8 Inform us if your child is subject to a Court Order and provide us with a copy of such order upon request.
2.9 Inform us immediately if you are unable to collect your child by the official collection time.
2.10 Inform us at least 24 hours before that your child will not be attending.
*Crazy 4 Kids accept no responsibility for any injuries or lack of medication administered due to inadequate / lack of up to date information.
**Your child cannot attend if they are suffering from a contagious disease and we reserve the right to ask you to collect your child immediately if we believe they are.
***If we are not reasonably satisfied that an individual can collect your child, we will not release your child into their care.
2.11 Give at least one month’s notice in writing to cancel your child’s place or to make any changes to your child’s regular attendance, i.e. changes in days, reductions in hours, increase of hours / days, etc.
2.12 Any reduction in hours or days attending given with less than one month’s notice will still be liable for full payment until the one month has expired.
2.13 Holiday Club places will have the Invoice generated upon booking and will be due before attendance.
2.14 Holiday club places once confirmed cannot be ‘moved’, cancelled or refunded.
3. Payment & Fees
3.1 Fees are charged either on a daily, sessional or hourly basis and charged monthly in advance.
3.2 Invoice payments are required by the 1st of the month relating to the Invoice.
3.3 Failure to pay your invoice by the due date will incur a £25 Administration charge and may result in your child’s place being suspended / or even cancelled.
3.4 Crazy 4 Kids’ reserves the right to pass on to our Debt Management Company any fees outstanding after 60 days and you will be liable for any additional fees incurred.
3.5 All payments made by you to Crazy 4 Kids Ltd must be made in the following way; by BACS payment, College or University Bursary, Childcare Vouchers, Standing Order or Debit / Credit Card.
3.6 Any additional sessions booked after the invoice has been generated for that month, will have an updated Invoice generated with payment due immediately.
3.6a You book only the Holiday Club days required as once confirmed cannot be ‘moved’ cancelled or refunded.
3.6b Sessions booked on a ‘one off’ basis must be paid at the time of booking or on the day of attendance.
3.7 No refund will be given for any period of absence by your child due to illness, family holidays, school trips or outings.
3.8 If we have agreed a payment plan with you but you fail to make payments as agreed, the full account will become due and any payment plans cancelled.
3.9 Where places are in high demand, Reception class children will be invoiced from the beginning of term, i.e. first school day in September, regardless of the school operating a ‘staggered ‘entry. This will ‘retain’ and secure a place for your child for when they start.
4.Suspension or Cancellation of Your Child’s Place – we may suspend your child’s place due to any of the following:
4.1 You have failed to pay your fees on time.
4.2 Your child’s behaviour whilst in attendance at Crazy 4 Kids Ltd is deemed by us as unacceptable or endangers the safety and / or well-being of the other children or staff.
4.3 Your behaviour toward a Crazy 4 Kids’ staff member, a child in our care or another Parent is deemed to be abusive or aggressive.
4.4 You willingly engage in discussions via groups or individually, online or in person, that could be damaging to a Crazy 4 Kids’ staff members reputation or deemed to be bringing the Company into disrepute without following the appropriate complaints procedures.
4.5 If the period of suspension exceeds one month, either of us may terminate the contract by giving written notice with immediate effect.
Suspension may be the correct course of action whilst we are working to resolve a particular issue
5. Termination of your Contract with Crazy 4 Kids Ltd
5.1 You may end your contract with Crazy 4 Kids Ltd by giving us one calendar months’ notice in writing.
We may immediately end this contract if:
5.2 You fail to pay your fees and have become uncontactable and are not responding to any of our efforts to communicate with you.
5.3 We take the decision to close the setting down due to low occupancy or loss of premises; we will give as much notice as possible of such a decision.
5.4 You may immediately end this contract if:
5.5 We have breached any of our obligations under this agreement and we cannot put right that breach within a reasonable period after you have drawn it to our attention.
5.6 We suffer any insolvency.
5.7 Your child’s behaviour whilst in attendance at Crazy 4 Kids Ltd is deemed by us as unacceptable or endangers the safety and / or well-being of the other children or staff.
5.8 Your behaviour toward a Crazy 4 Kids’ staff member, a child in our care or another Parent is deemed to be abusive, aggressive or grossly inappropriate.
5.9 You willingly engage in discussions via groups or individually, online or in person, that could be damaging to a Crazy 4 Kids’ staff members reputation or deemed to be bringing the Company into disrepute without following the appropriate complaints procedures.
6. Employment of Crazy 4 Kids Ltd Staff
6.1 If, during your Contract with us and for a period of 6 months after it has terminated, directly or indirectly employ or otherwise engage the services of any member of the Crazy 4 Kids’ Staff that has had contact with your child and allow or permit any childcare services to your child, you shall be liable to pay Crazy 4 Kids Ltd 20% of the gross annual salary of that member of staff at the time of their leaving. This figure represents the costs to us of recruiting a suitable replacement member of staff.
7.1 We have an obligation to report any instances where we consider that a child may be at Risk of Harm through neglect or abuse to the relevant authorities. We may do so with or without your consent and with/without informing you.
7.2 If the setting that your child attends has to close, or we make the decision to close due to events or circumstances out of our control we shall be under no obligation to provide alternative childcare facilities for you or refund any fees. If the closure exceeds 3 days in duration (excluding any days that your setting would normally be closed), we will credit you with an amount that represents the number of days your setting is closed in excess of the 3 days.
7.3 If you should have any concern over the services that we provide please discuss this in the first instance with your Setting Supervisor / Manager; if it cannot be resolved this way then the next ‘line’ of Management and or the Registered Provider will respond to your concerns within 24 hours of receiving it.
7.4 We ensure that all of our settings have a wide variety of equipment so request that your child does not bring in toys from home; if they do bring them in, we take NO responsibility for their loss or damage.
7.5 In the interest of keeping all children ‘Safe’ we request that children do not bring any devices into a Crazy 4 Kids setting that can access the internet without WIFI or can take photographic images of the other children whilst they are in attendance.
7.6 Parents and / or their representatives whilst dropping off or collecting children MUST NOT use their mobile phone or any other photographic devise whilst on a Crazy 4 Kids’ premises and may be asked to leave or refused entry if they are found to be doing so. This is to protect all children in attendance and we appreciate your co-operation in maintaining the safety of all attending.
You will be asked to sign a paper copy of this Parental Contract on your Child’s first session. This will be kept with your Child’s admission form.

Why do we collect personal data about you?
We collect personal data from you, so we can provide education and children’s services to you and your family; to monitor our work; and to let us fulfil our statutory obligations and statutory returns as set by the law.
How we protect and use your personal data
All personal data we collect from you complies with the data protection principles, as stated in the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 and Registration with the Information Commissioner’s Office. The personal data we collect may be held as an electronic record on our data systems and / or as a paper record. The records are only seen by staff who need the data to deliver the service to you. We make every effort to keep your personal data accurate. If you tell us of any changes in your circumstances, we can update the records with the personal data you choose to share with us. We will keep the personal data for no longer than is necessary. Sometimes, the law sets the length of time personal data must be kept.
Data we will collect
We hold only the information necessary to provide a childcare service for each child. This includes child admission information, medical information, parent and emergency contact information, attendance records, incident and accident records and so forth.
Sharing personal data

You have the right to ask us to stop processing your personal data. However, this may stop us delivering a service to you. Where possible, we will do as you ask, but we may need to hold or process personal data to comply with a legal requirement. If you find that the personal data that we hold is no longer accurate, you have the right to have this corrected.
If you no longer use services provided by Crazy 4 Kids or if we stop providing the service, it can take up to 90 days to archive your account. Accounts can only be archived if your account balance sits at a balance of zero.
